Financial Services
Regulatory – lawyers

Our clients face increasing scrutiny to meet regulatory, compliance and conduct requirements. SHIFT’s team of senior financial services lawyers bring on-the-ground experience in the banking, wealth, funds management and insurance sectors to help you navigate regulatory change, plus a deep understanding of the conduct overlay.

SHIFT’s offer is unique. We offer not only experienced financial services lawyers but also senior risk and compliance Consultants (see SHIFT Compliance), to provide a full complement to your regulatory change project.

SHIFT lawyers work closely with you and your team – not just to summarise the law change, but to offer a pathway to implementation across your business. Rather than diverting existing staff from BAU, let our senior legal support the end-to-end execution of specific projects or join your project teams on a contract basis. SHIFT also offers regulatory change consultancy services to meet your needs.

We Can Deliver

SHIFT’s senior financial services lawyers can assist with a wide variety of Regulatory Change projects including:
Conduct Regulation

Our lawyers can work with you to help analyse and implement the Conduct of Financial Institutions Bill. They can leverage their experience working with clients on their responses to conduct regulation by the Financial Markets Authority (FMA) from the 2018 and 2019 RBNZ and FMA reviews of bank and insurer conduct.

BS11

Our lawyers support banks on their BS11 regulatory responses – including working with the RBNZ’s policy directives regarding outsourcing of functions and services. These roles cover assessment and uplift of existing bank outsourcing arrangements and embedding RBNZ banking standards into each bank’s ongoing governance.

CCCFA

Our lawyers work within bank and building society teams on their CCCFA regulatory change projects, advising across the entire landscape, considering obligation sets, future needs, and product assessments, through to implementation, and remediation.

Funds Management

SHIFT’s funds management lawyers know the FMCA intimately and can join your existing legal team or provide interim cover. Our expertise includes advising on merger and acquisition activity, assisting with licensing requirements, and reviewing disclosure documents.

TESTIMONIALS

What our clients say…

“One of the big things Prue did really well was spend time on the ground with the team at the bank, understanding where the issues were, programmes of work coming up, and how the budgets worked. SHIFT has good quality people on the books. They’ve all done a really good job – there hasn’t a been dud at all, which is pretty unusual across the board. This is a given with SHIFT. In our recruitment we have hits and misses but not with SHIFT. When you go the recruitment route, it is the most painful, torturous experience. SHIFT avoids that pain. Your flexibility is key.”

What our Consultants say…

“There are a tonne of personal benefits in working for SHIFT. They are just so nice to deal with; flexible; incredibly responsive; very human and you don’t feel like a cog in a big machine. The other massive advantage is I haven’t had to go out and find my own jobs. It’s seamless to find my next role and any gaps between roles are because I choose them to fit my lifestyle. If I knew someone returning from overseas, I would always recommend them to SHIFT.”
